County of the Superior Court in which the bond is filed
The bond is required of a plaintiff who requests that writ of attachment (attachment is the act of seizing property to secure a judgment) be placed on the defendant’s property. The bond is required when a sheriff must attach (legally take) the property of the defendant.
The bond is required to protect the sheriff against all damages, costs, charges and expenses of any nature that may be sustained by the Sheriff in the process of attaching the property. The plaintiff will be held liable for any loss of liability that occurs in the attachment of the property.
The bond protects the sheriff who will be attaching the property under the writ of attachment on behalf of the plaintiff. The plaintiff indemnifies the sheriff for all damages, costs, expenses, losses or liability that may occur during the attachment.
In order to issue a Indemnity to Sheriff bond, the following information is required:
Once this information is received, a response as to approval will be provided within 1-2 business days.
Once the bond has been issued and released to the principal, it must be filed with the court. The court will maintain the bond and determine when the liability has been released.
